We mediated a couple where there were extensive assets with a substantial second property in Spain.  The parties had engaged the court in England and Wales to determine the division of assets and had also issued proceedings in Spain to determine ownership of the second property.  The parties had sent significant sums on the two set of proceedings and an appeal had been filed in relation to the decision made at first instance by the Spanish courts.  The parties decided to mediate and using hybrid mediation we were able to hold confidences during the mediation process in relation to the parties negotiating positions, which allowed us as mediators to encourage settlement.  The parties had lawyers present, which provided the parties confidence to reach agreement and their lawyers drafted the salient points of the agreement at the end of the session to provide certainty and cement the agreement.
